The pocket bike you purchased or obtained is strictly forbidden to operate on a sidewalk, roadway, or any other portion of a road, or on a bicycle path, bicycle path or trail, equestrian trail, hiking or pathways, or on public lands open to OHV use. A violation of this regulation may lead to prosecution and seizure of the aircraft.
Pocketbike small motorcycles are powered by gasoline engines or 40-49cc of electric motors. They are marketed and sold improperly as motor scooters. "Pocket bikes meet the definition of a motorcycle as defined by California Vehicle Code 400 (a):
HVAC 400 (a): A motorcycle is a motor vehicle having a seat or saddle for use by the driver, designed to travel on not more than three wheels in contact with the ground and weighing less than 1500 lbs. As motorcycle engines are 150cc pocket, they are also defined as a "moped" CVC 405C
VC 405: A "moped" is a motorcycle with an engine that displaces less than 150 cubic centimeters.
A motor cycle must be registered with the DMV for use on a highway or off-street public parking. The rider must be issued a valid driver's license with M1 (motorcycle) endorsement by CVC12500 (b) and CVC12804.9 (a). The rider must wear a helmet approved by CVC27803. The motor cycle shall also be equipped with all safety equipment required.
The DMV is not currently marked "pocket bikes" because of a lack of identification numbers required (Vehicle Identification Number and Engine Number). This means that the "pocket bikes" can be driven on any road or off street parking.
If the pocket bikes are properly registered (if the DMV registration permit at a later date), riders must obey all rules of the road and equipment requirements apply as would any other motorcycle or vehicle and subjected to citations for violations observed by officers of this department.
Pocket bikes can still be used on private property (areas not open to public traffic) is urging riders to get training in the safe operation of vehicles and safety equipment.
